Why
the name Scots media?
Many editors and publishers do not appreciate the differences
between media law in Scotland and the rest of the UK.
Scotland has its own legal system and there are clear differences
in the way Scottish courts will interpret the law from that
of their English counterparts.
For instance the law of contempt of court is enforced much more
strictly in Scotland. A right to sue for defamation can live
on in Scotland long after that right has expired in England.
And in recent years, Scottish judges have taken a stringent
line on libel, awarding six-figure sums of damages in two recent
cases.

The fact that Scots read more newspapers and magazines than any other part of the UK is well known to publishers.
With ever more publications targeting Scottish readers, the
potential for pitfalls is growing. Should something go wrong,
it will be of little value to argue that a publication was approved
by lawyers in London.
When publishing, issues of data protection, copyright, comparative
advertising, database rights, passing off, and trade marks all
need to be considered, notwithstanding the effects that these
have if you publish online.
