Passing Off

The law of passing off and Trade Mark are similar in many respects. An owner who has established goodwill in services or goods can be protected through an action of passing off.


Unlike Trade Marks, this protection is not afforded by statute but by common law, and does not depend on registration.
 
If an owner can show that a third party is using a similar iidentity, name or look, this can amounts to misrepresentation and owner may have a right of action to protect their work.
