The Data Protection Act 1998 requires that anyone who processes
personal data must notify the Information Commissioner
(unless exempted within the Act).
Personal data must be processed within the following data protection
principles:
Processed fairly and lawfully.
The data is adequate, not excessive and for the purpose
in which the data was obtained.
The data is accurate.

Whereby data is transferred to a country outwith the
EEC that there is an adequate level of protection for data subjects.
That appropriate measures are taken to prevent unauthorised,
accidental destruction, loss or unlawful processing.
That the data is kept for a reasonable period and not
longer then necessary.
It is obtained for specified and lawful purposes.
That the data is processed with the agreement of the rights
of the data subjects.

Where you have suffered damage through a breach of the Act/principles
you are entitled to compensation.
Businesses must take steps to ensure that they do not contravene
the Data Protection guidelines, which could leave them open
to a claim.
