Passing Off

Our team successfully represented Scotsman Publications Limited in a case raised against them by Caledonian Magazines Limited seeking interdict for the use of the term “The Great Outdoors”.
 
Scotsman Publications Limited had sought to publish a supplement within one of their publications headed “The Great Outdoors”.
 
We successfully argued that no interdict should be granted as there would be no passing-off in this case.
 
Our team successfully acted for Haggis Backpackers Limited in interdicting a company who sought to register their trading name as their domain name.
 
The company, who were a rival to our clients, had sought to disrupt our clients’ business by registering their trading name and its other similar domain names.
 
Our clients recovered the full costs of the interdict procedure from the other party.
